Compensation for Amputees
There are different types of personal injury claims that can be brought on behalf of amputees, such as:
Claims against Companies or Wrongdoers that do not employ the amputee;
Third Party Claims (such as Faulty Equipment);
Lawsuit for an Unnecessary Amputation; and
Workers Compensation;
Our law firm has prosecuted claims and recovered compensation for amputees. Each case is different. Often, an amputee may not realize that there may be other forms of compensation available to them. If someone is hurt while on the job there often is workers compensation available for him or her. However, workers compensation is not designed to completely compensate an injured worker, like many amputees. To fill this void in many workers compensation systems, there are third party claims that can be brought to obtain additional compensation. Examples of third party claims include negligence and strict products liability claims.
In one case, we represented a gentleman who only believed that he had a workers compensation claim, but what he did not realize was he also had a third party claim. The compensation paid to him from the third party claim ended up being very significant to him---and his family--as it will help pay for his future prosthetic needs and the physical pain associated with his amputation. Although not every amputees case will have a third party claim it is important that each amputee look into whether they may have one.
